These terms are the agreement between you and 2FLY Digital Marketing for using MagicBuild, the app contractors use to estimate, run and get paid for jobs. Clients who open an estimate or invoice link are covered too. We wrote them to be read, not skimmed past — if anything is unclear, ask us.
Contractors — the business that signs up for MagicBuild, plus the crew members it invites. The person who creates the account confirms they can bind that business.
Clients — anyone who receives an estimate, contract, invoice or payment link from a contractor through MagicBuild. Clients don’t need an account, and using a link means accepting the parts of these terms that apply to them (sections 4, 5 and 8).
MagicBuild is software: it helps a contractor write estimates, send them, get them signed, schedule crew, track time, invoice and collect payment. The contractor decides the price, the scope and the wording of their documents; we provide the tools.
2FLY Digital Marketing is not a party to the contract between a contractor and their client, and is not a contractor, an insurer, a bank or a law firm. Suggested wording, AI-generated estimates, measurements read from photos and price guidance are starting points that the contractor must check before sending. Only the contractor is responsible for what they send.
Sign-in is by a one-time code sent to your email. Keep that inbox secure; anything done from a signed-in device counts as done by you. Tell us right away at hello@2flydigital.com if you think someone else has access.
Crew members invited to a company see the jobs they are assigned to and the tools to check in and out. The company owner controls who is on the crew and can remove access at any time.
Estimates, contracts, change orders and invoices in MagicBuild are delivered and signed electronically. By ticking the consent box on an estimate link and signing, a client agrees that their electronic signature is legally binding, the same as a handwritten one, under the U.S. ESIGN Act and applicable state law (including UETA).
Online payments are processed by Stripe under its own terms; MagicBuild never sees or stores card or bank numbers. Money paid on an invoice or deposit goes to the contractor’s connected Stripe account, less Stripe’s processing fees and any platform fee shown to the contractor when they connect.
Refunds, disputes and questions about work performed are between the client and the contractor. Payments recorded by hand (cash, check, Zelle) are the contractor’s own records.
If a contractor connects QuickBooks, Stripe or another service, MagicBuild sends the data needed to do what the contractor asked (for example, copying invoices and payments into QuickBooks). Those services have their own terms. Disconnecting stops new data from flowing; it doesn’t delete what was already sent.
Pricing is shown in the app or on our site at the time you sign up. Paid plans renew automatically until cancelled; you can cancel any time from Settings, and the plan stays active until the end of the period already paid for. No partial-period refunds unless the law where you are requires one.
A free trial needs a card on file. Nothing is charged until the trial ends; cancel from Settings before then and you owe nothing. We remind you by email before the first charge.
During a free trial or beta, features may change and we may reset sample data. We’ll give reasonable notice before turning off anything you rely on.
Contractors own their business data: leads, estimates, photos, invoices, crew records. We use it to run the service for you as described in the privacy policy. You can export it and you can ask us to delete your account and its data.
Clients’ information (name, contact details, job address, signature) is collected on the contractor’s behalf. The contractor is responsible for having the right to enter it; we hold it for them.
Parts of MagicBuild use AI to draft estimates from photos, video and voice notes, read receipts and answer questions. The output can be wrong. It is a draft for the contractor to review and edit, never a substitute for a site visit, a measurement or professional judgment. Don’t rely on it for safety-critical, structural or code-compliance decisions.
We work to keep MagicBuild available and backed up, but it is provided “as is” and “as available”. We may update, add or retire features. If we make a change that materially reduces what you paid for, you can cancel and we’ll refund the unused part of the current period.
To the fullest extent allowed by law, 2FLY Digital Marketing isn’t liable for indirect, incidental, special or consequential damages, lost profits, or lost data arising from your use of MagicBuild, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
Nothing here limits liability that can’t be limited by law, including for fraud or gross negligence.
A contractor agrees to cover 2FLY Digital Marketing for claims by third parties (including their clients) that arise from the contractor’s work, their documents, their pricing, or their breach of these terms.
You can close your account any time. We may suspend or close an account that breaks these terms, after telling you why unless the law prevents it or the risk is urgent. After closure we keep data only as long as the privacy policy describes, then delete it.
These terms are governed by the laws of the State of Massachusetts, United States, without regard to conflict-of-law rules. Before going to court, both sides agree to try to resolve a dispute in good faith by contacting hello@2flydigital.com. If that fails, disputes go to the state or federal courts located in Massachusetts, and each side consents to that venue.
When we update these terms we’ll change the date at the top and, for material changes, notify account holders by email or in the app at least 14 days before they take effect. Continuing to use MagicBuild after that date means accepting the new terms.
